These Terms of Service (“Terms”) govern your access to and use of www.bknutrition.com (the “Site”) and the purchase of any products from BK Nutrition LLC (“BK Nutrition,” “Company,” “we,” “us,” or “our”).
BY ACCESSING THE SITE OR PURCHASING ANY PRODUCT, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.
1. ELIGIBILITY
You must be at least 18 years old to use this Site or purchase products.
By using this Site, you represent that:
· You are legally capable of entering a binding contract.
· You will use products only as directed.
· You will not misuse products.

3. ASSUMPTION OF RISK

BK NUTRITION LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, ATHLETES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
THIS INCLUDES, BUT IS NOT LIMITED TO:
· LOST PROFITS
· LOST REVENUE
· PERSONAL INJURY (TO THE EXTENT PERMITTED BY LAW)
· ALLERGIC REACTIONS
· MISUSE OF PRODUCT
· SHIPPING DELAYS
· THIRD-PARTY ACTS
MAXIMUM LIABILITY CAP:
Our total liability shall not exceed the amount paid for the product giving rise to the claim or $100, whichever is greater.
YOUR SOLE REMEDY IS A REFUND STRICTLY PURSUANT TO OUR REFUND POLICY.
6. NO PERSONAL LIABILITY OF OWNERS
You agree that any claim must be brought solely against BK Nutrition LLC as an entity.
You waive any right to assert claims against the Company’s owners, members, managers, officers, directors, employees, or affiliates in their personal capacity.
7. INTELLECTUAL PROPERTY
All content on the Site including:
· Logos
· Product names
· Branding
· Images
· Videos
· Marketing materials
· Designs
Are the exclusive property of BK Nutrition LLC.
Unauthorized use is strictly prohibited.
8. INFLUENCER & AFFILIATE DISCLAIMER
Influencers, affiliates, and athletes may promote BK Nutrition products.
Their statements:
· Reflect personal opinion.
· Are not medical advice.
· Are not guarantees of results.
BK Nutrition does not authorize affiliates to make disease claims.
9. USER CONDUCT
You agree not to:
· Engage in fraud
· Abuse discounts
· Initiate false chargebacks
· Provide false shipping information
· Use the Site unlawfully
Accounts engaging in fraud may be permanently banned and reported.
10. SHIPPING & REFUND POLICY INCORPORATION
Our Shipping Policy and Refund Policy are incorporated into these Terms by reference.
11. AMAZON & THIRD-PARTY MARKETPLACE SALES
Authorized Channels
BK Nutrition products are guaranteed only when purchased directly from:
· The official BK Nutrition Amazon storefront (if applicable)
Products purchased from unauthorized sellers may:
· Be counterfeit
· Be expired
· Be improperly stored
· Be altered or tampered with
We reserve the right to deny refunds or support for products purchased from unauthorized sellers.
Amazon Purchases
If you purchase through Amazon:
· All returns and refund requests must be processed through Amazon.
· Amazon’s A-to-Z Guarantee policy governs your purchase.
· BK Nutrition cannot override Amazon decisions.
· We do not issue direct refunds for Amazon purchases.
Proof of Purchase Required
Valid proof of purchase from an authorized seller is required for any warranty, refund, or claim.
Counterfeit & Diversion
BK Nutrition actively monitors unauthorized resale.
We reserve the right to:
· Report unauthorized sellers
· Pursue legal remedies
· Deny support for diverted goods
12. DISCLAIMER OF WARRANTIES
The Site and products are provided “AS IS” and “AS AVAILABLE.”
We disclaim all warranties, express or implied, including:
· Merchantability
· Fitness for a particular purpose
· Non-infringement
13. FORCE MAJEURE
We are not liable for delays or failures due to events beyond our control, including:

· Government action
· Supply chain interruption
14. DISPUTE RESOLUTION – MANDATORY ARBITRATION
ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS SHALL BE RESOLVED BY BINDING ARBITRATION IN BOCA RATON, FLORIDA.
Arbitration shall be conducted under the rules of the American Arbitration Association.
YOU AGREE:
· TO ARBITRATE INDIVIDUALLY
· TO WAIVE CLASS ACTION RIGHTS
· TO WAIVE JURY TRIAL RIGHTS
The arbitrator may not award punitive damages.
If arbitration is deemed unenforceable, disputes shall be resolved in Florida courts.
15. GOVERNING LAW
These Terms are governed by the laws of the State of Florida.
16. MODIFICATIONS
We reserve the right to modify these Terms at any time.
Continued use of the Site constitutes acceptance of updated Terms.
